Yesterday’s UK Budget confirmed that George Osborne is seeking to reform IR35 instead of abolishing it.

John Brazier, Managing Director of PCG, the leading body representing the UK’s freelance community said:

“The Government has accepted that HMRC’s administration of IR35 over the last 11 years has been far from satisfactory and the status quo cannot continue.

“We are encouraged that the Government intends to put in place various mechanisms to ensure HMRC improve its processes of administration. We intend to play a key part in this process and are determined as a result to exclude all legitimate freelancers from the ongoing threat of an IR35 investigation, with all the uncertainty that brings”.

PCG, in conjunction with Ernst & Young, have developed a Business Test which, if adopted by the OTS (Office for Tax Simplification) would offer the clarity and certainty that the freelance and entreprenuerial communities require.

Neil Lewis added “clarification will help remove the uncertainly that surrounds IR35 and allow freelancers and entrepreneurs to concentrate on growing businesses rather than managing unknown risks with HMRC”.
